What is the difference between an LLC and an S-Corp?
An LLC is a legal entity formed with the state. An S-Corp is a federal tax election filed with the IRS. You form an LLC and then elect S-Corp tax treatment by filing Form 2553. The entity is still an LLC but the tax treatment changes, which is what eliminates the self-employment tax on distributions.
When does the S-Corp election make financial sense?
Generally when net profit exceeds $75,000 per year. Below that the compliance costs can outweigh the savings. Harbor Point calculates your exact break-even point before you commit to anything.
I already have an LLC and missed the S-Corp election deadline. What now?
